“Amid the laughter that followed ... one said, ‘oh f***, shit, my bad’,” Elliott said.

“We know this horror show occured because children in the car ... recorded it on their phones.”

The teen was arrested on those matters and released on bail after 11 days in custody.

But Elliott said two weeks later, the boy allegedly engaged in high-risk criminal conduct again. He is accused of stealing a Mazda during an aggravated burglary at Wonthaggi before crashing into a Ford Ranger at Dalyston on February 28.

As a result, he was rearrested and granted bail again, this time in the Supreme Court on March 21, but he was rearrested on Wednesday following the string of alleged breaches.

Elliott noted between May 31 and February 27, the 14-year-old was reported missing from his care home 46 times, all in breach of his various bail conditions.

  • February 28, 2024 - stolen vehicle, hit-run, petrol drive-offs

  • March 27, 2024 - theft of motor vehicle

He also allegedly told family that as soon as he was released from custody, he would steal cars again.

The teen later told caseworkers he had used cannabis, alcohol and methamphetamine while in the care of the state.

His most recent bail conditions included a curfew, not to drive a car, steal any cars, use drugs or alcohol, attend court in person, and not associate with co-accused. All were allegedly breached, Elliott said.

“Regrettably ... [the teen] has chosen to flout his conditions of bail. Not only has he consciously chosen to breach bail conditions yet again, it’s alleged he willingly entered another stolen vehicle, and then travelled in that vehicle in very dangerous circumstances,” the judge said.

“Each time a child steals and drives a car, the child is putting everyone in the vicinity in grave danger.”

In opposing bail, police prosecutor Amitoj Singh told the court the boy’s behaviour had escalated to a point where the public was being placed in danger.

The 14-year-old is one of five teens charged over the Beach Road hit-run attacks.

One of the injured cyclists remains in hospital being treated for his brain bleed, while a second, who sustained three fractured vertebrae and a shattered ankle, faces a prolonged recovery from “life-altering” injuries, the court earlier heard.

Elliott ultimately refused bail with the matter to return to court in April.
