But when police asked clarifying questions of Mr Kadik in his interview he refused to answer them, magistrate Charlie Rozencwajg was told.

Mr Kadik, 22, of Roxburgh Park, is charged with murder along with Maytham Hamad, 24, of Mill Park, Ahmed Al Hamza, 22, of West Melbourne, and Ali al-Khafaji, 23, of Lalor.

Police allege the four men waited for Mr Teriaki and when he arrived at his parents’ home they confronted him.

They allegedly chased him for about 300 metres when Mr Teriaki got out of his car and ran.

Mr Al Hamza’s DNA was found on a broken piece of the baseball bat, the court heard.

The accused men are to face a three-day hearing from August 12 which will determine whether they stand trial.

Lawyers for Mr Al Hamza and Mr al-Khafaji plan to argue at that hearing their clients should have their murder charges dropped because of a lack of evidence.

Next month’s hearing could focus on whether Mr Teriaki was known to carry firearms and whether he and the accused men were members of rival groups.

Mr Rozencwajg asked on Tuesday whether Mr Teriaki had prior convictions but a detective replied he was unsure.

The four accused men were remanded in custody to return to court for the committal hearing.
