As police attempted to remove him from their van, he then repeatedly swore and tried to kick and spit at them before he was subdued with capsicum spray.

He later pleaded guilty to intentionally causing serious injury, resisting an emergency worker and offending while on bail.

Warner, who has autism and an intellectual disability, left the dock at the County Court of Victoria on Monday during his sentencing in a "very agitated" state.

The court was told the 33-year-old could not be brought back into the court without force, so he was sentenced in his absence.

"You were very intoxicated and in combination with some pre-existing psychological difficulties, you reacted in a violent manner," Judge Trevor Wraight said.

Warner was jailed for five years and eight months of which he must serve a minimum four years before he is eligible for parole.

He has already served 358 days in pre-sentence detention.
